Welcome to mediobyte. These Terms and Conditions govern your use of our website and the website design services provided by mediobyte. By accessing our services, you agree to be bound by these terms.

1. Scope of Services

mediobyte provides professional website design, development, and related digital services. The specific deliverables, timelines, and costs for your project will be outlined in a separate Project Proposal or Statement of Work (SOW) agreed upon by both parties.

2. Client Obligations and Content

  • Asset Provision: You agree to provide all necessary text, images, logos, and information required for the website design in a timely manner.

  • Delays: mediobyte is not responsible for project delays caused by a lack of client feedback, missing content, or delayed assets.

  • Content Rights: You guarantee that all materials provided to us are owned by you or that you have permission to use them.

3. Payment Terms

  • Deposits: A non-refundable deposit (specified in your SOW) is required before any design work begins.

  • Milestones: Final project delivery and launch are contingent upon receiving full and final payment.

  • Late Fees: Overdue invoices may incur a late payment fee as detailed in your specific billing agreement.

4. Revisions and Approvals

  • Projects include a designated number of revision rounds as specified in your proposal.

  • Requests for design changes outside the original project scope or after final approval will be subject to additional fees at our standard hourly rate.

5. Intellectual Property Rights

  • Your Content: You retain all copyrights to the text, images, and data you provide.

  • Final Design: Upon receipt of final payment, full ownership of the custom visual website design will be transferred to you.

  • Agency Promotion: mediobyte retains the right to display the completed website and design assets in our portfolio and marketing materials unless otherwise agreed in writing.

6. Third-Party Services

If your website requires third-party services (such as web hosting, domain registration, premium plugins, or payment gateways), you are responsible for maintaining those individual accounts and subscriptions. mediobyte is not liable for service disruptions caused by third-party providers.

7. Limitation of Liability

mediobyte strives to deliver high-quality, functional websites. However, we do not guarantee that the website will always be error-free or uninterrupted. mediobyte will not be held liable for any lost profits, lost data, or incidental damages arising out of the use or inability to use the website.

8. Termination

Either party may terminate the project agreement with written notice if the other party breaches these terms. If the project is canceled by the client before completion, you will be invoiced for all work completed up to the date of termination.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with local laws, and any disputes will be subject to the exclusive jurisdiction of the local courts.
